Case law –  This 2 hour CPD webinar will introduce you to the wealth of binding case law from appeals to Divisional Court and the Ontario Court of Appeal.  These appeals are binding on the Board, and can be used to bullet-proof your case.  LTB decisions may be persuasive, but decisions from the appeal Courts have the real power.

You will receive the most on-point appellate decisions that I keep in your everyday case law file.  We will discuss the important decisions, how they can be argued and what the ratio of each case is.  For new paralegals, it will be an overview of the importance of case law.  For experienced paralegals, it will provide you with the leading cases that can improve your practice results.

Evictions for Landlord or Purchaser Use + Renovation and Demolition – In this 1 hour CPD webinar which includes all the 2020 & 2021 Bill 184 changes, we discuss No Fault Evictions, that is, those for landlord and purchaser use, as well as for demolition and extensive renovation.  Ontario’s 2017 RTA rule changes made these applications more complex, and the recent 2020 changes made it quite punitive for landlords who have provided the tenant with a bad-faith N12 notice. This is our #1 downloaded product.

Learn strategies for successfully evicting for recovery of the unit for the landlord or purchaser or their family.  A lot of these applications are dismissed by the LTB, and large fines of up to $35,000 can be imposed by the Board for bad-faith evictions.  Avoid being another statistic.  Also learn how to stay out of trouble and avoid having to pay LTB fines, provincial offences fines (up to $250,000) and compensation to former tenants of more than a year’s rent.

The LTB’s new L10 form and new service requirements will be explained.

We’ve added a second part to this CPD describing how to enforce LTB judgements, both for eviction with the provincial Sheriff, and for monies at Small Claims Court. We take you through the entire enforcement process step by step. Included are samples of filled-in Sheriff and Small Claims Court forms. We also cover the new and controversial 2020 private re-payment agreements from Bill 184 which allow a landlord and tenant to avoid the LTB completely, but allows for the landlord to file directly for eviction if the tenant breaches the terms of the private repayment plan. These s.206 agreements are a benefit to landlords, but dangerous for tenants.

Reviews, Amendments & Appeals under the RTA – This 2 hour CPD webinar teaches you administrative law principles which are vital when you are arguing reviews at the LTB.  Many paralegals don’t properly prepare themselves and fail to argue admin law principles such as curial deference, standard of review, discretion to fact-finders etc.  This CPD will make you a better overall paralegal, teaching you how to draft review requests at the LTB that will more often than not, get you to a review hearing.  We will talk about the 3 stages of review under the Rules, and of course look at the Rule and Guideline on Reviews.  You will receive a number of different review requests to help guide you in your own drafting.

We will also talk about requests to amend, the difference between amendments and reviews, when amendments should be granted and when they cannot, and the timing issues around amendments.  Finally we will be speaking of the statutory right of appeal under the RTA, and why and how you should look at EVERY LTB hearing as a first step in a successful appeal if it should to to Divisional Court.
