The LTB website has raw, dry information. It is not helpful in understanding real-world strategies, nor does it structure information into a cohesive package on a topic-by-topic basis. There is also a bias in favour of tenants. The same can be said about the LTB call centre.

Great question. It depends. Professionals like lawyers and paralegals are expensive. Paralegals less so, but sometimes it doesn’t make sense to spend more money on legal fees than the dispute is about. The answer depends on your own comfort level with appearing at the LTB and presenting your case. If the matter is messy or complicated, I often recommend having a paralegal represent you.

If you lose, you either start over, or even worse, you can’t start over because the decision is final. When deciding if these packages are right for you, consider what happens if you lose. Consider the cost of a lawyer or paralegal. Or starting over while rent is not being paid.

We talk a lot about the N4 notice, the importance of getting it right, what are allowable charges on the rent ledger, making sure the tenant doesn’t claim they never received it, how the “voiding” of N4 notices. work. The importance of specificity in the notices is demonstrated, as well as the timing issues for service and termination dates. There is a chart which explains the timing issues for each notice. If a tenant does not engage in conduct issues, there is no way to get your home back except for what we call the “No Fault” applications. Those are the N12 and N13 notices.
